General Terms and Conditions of Sale

These general terms and conditions of sale, hereinafter referred to as the "Terms and Conditions", apply to any order for products placed on the website www.gmouton.com, operated by Dr Georges MOUTON.
Article 1 - Purpose
These Terms and Conditions are intended to define the terms under which the seller offers products for sale through the website www.gmouton.com, including books, publications, or any other product displayed on the site.
They do not govern medical services, consultations, appointment bookings, requests for medical information, or informational content published on the website, which are subject to separate conditions.

Article 3 - Acceptance of the Terms and Conditions
Any order placed on the website implies full and unconditional acceptance of these Terms and Conditions by the customer, to the exclusion of any other document, unless expressly agreed otherwise in writing by the seller.
The customer acknowledges having read these Terms and Conditions before confirming the order.
Article 4 - Products
The products offered for sale are those displayed on the website on the day of consultation by the customer, subject to availability.
The seller makes every effort to present the products as accurately as possible. However, photographs, visuals, descriptions, extracts, formats, dimensions, colours, or presentations are not strictly contractual and shall not engage the seller’s liability in the event of minor differences.
The seller reserves the right to modify the range of products offered on the website at any time.
Article 5 - Prices
Product prices are indicated in euros.
Unless otherwise stated, prices are [VAT included / VAT excluded].
Delivery charges are indicated to the customer before final confirmation of the order.
The seller reserves the right to change prices at any time, it being understood that the price applicable to the order is the one in force at the time the order is confirmed.
Article 6 - Orders
The customer selects the products he or she wishes to purchase and follows the ordering process available on the website.
The order shall only be deemed final after validation of the basket, acceptance of these Terms and Conditions, provision of the information necessary for the order, and full payment of the price, unless otherwise expressly agreed.
The seller reserves the right to refuse or cancel any order in the event of a previous dispute with the customer, non-payment, incomplete or manifestly incorrect details, fraud, or reasonable suspicion of fraud.
Article 7 - Availability
Product offers are valid as long as they are visible on the website and subject to available stock.
In the event of product unavailability after an order has been placed, the customer shall be informed as soon as possible. The customer may then obtain reimbursement for the unavailable product or, where offered, a credit note or replacement product of equivalent value.
Article 8 - Payment
Payment shall be made using the payment methods offered on the website at the time of the order.
The customer guarantees that he or she is duly authorised to use the chosen payment method.
The seller reserves the right to suspend or cancel any order in the event of non-payment, payment incident, or fraud.
Article 9 - Delivery
Products are delivered to the address provided by the customer when placing the order.
Delivery times are given for information purposes only, unless otherwise expressly stated.
The customer must check the condition of the parcel and products upon delivery and report any anomaly to the seller in writing within a reasonable period.
Risk passes to the customer upon delivery or handover of the product.
Article 10 - Right of Withdrawal
Where the customer is acting as a consumer and the order is concluded at a distance, he or she shall in principle benefit from a 14-day withdrawal period, subject to the applicable legal exceptions.
To exercise this right, the customer must send the seller an unambiguous statement by e-mail or post to the contact details set out in Article 2.
Products must be returned in their original condition, complete, undamaged and, where possible, in their original packaging.
Reimbursement of sums paid shall be made in accordance with the applicable law, subject where appropriate to receipt of the returned goods or proof of shipment.
Article 11 - Exceptions to the Right of Withdrawal
The right of withdrawal may in particular not apply in the cases provided for by law, especially for certain digital content, personalised products, unsealed goods that cannot be returned for reasons of hygiene or health protection, or other legal exceptions.
Article 12 - Returns and Complaints
Any complaint relating to an order must be sent to the seller within a reasonable period following receipt, at the following e-mail address: contact@gmouton.com.
The customer must indicate at least his or her identity, the order number, the product concerned, the nature of the complaint and, where appropriate, any supporting document or photograph.
Article 13 - Legal Warranty
Consumer customers benefit from the legal warranties applicable under Luxembourg law and, where appropriate, from any mandatory provisions of the law of their country of residence if more favourable.
The legal warranty does not cover normal wear and tear, misuse, lack of maintenance, accidental damage or use not in accordance with the intended purpose of the product.
Article 14 - Liability
The seller shall not be held liable for non-performance or improper performance of the contract in the event of fault on the part of the customer, an unforeseeable and insurmountable act of a third party, or force majeure.
The content published on the website is for general information purposes only and does not replace personalised advice, diagnosis or appropriate care.
Article 15 - Intellectual Property
All elements appearing on the website, including texts, visuals, graphics, logos, photographs, videos, documents, the general structure of the site and editorial content, are protected by intellectual property rights.
Any reproduction, representation, distribution, adaptation or exploitation, in whole or in part, without prior written authorisation, is prohibited.
Article 16 - Personal Data
Personal data collected in connection with orders are processed for order management, delivery, invoicing, customer relations and complaint handling.
Customers are invited to consult the website’s privacy policy for further information on the processing of their personal data.
Article 17 - Consumer Dispute Mediation
In the event of a dispute, the customer is invited to first send a written complaint to the seller in order to seek an amicable solution.
Failing an amicable settlement, the consumer may refer the matter to the competent consumer mediation service in accordance with the applicable legislation.
Article 18 - Applicable Law and Jurisdiction
These Terms and Conditions are governed by Luxembourg law, subject to any mandatory consumer protection provisions from which the consumer may benefit under his or her national law.
In the event of a dispute and failing an amicable resolution, the competent courts shall be determined in accordance with the applicable rules of Luxembourg law and, where appropriate, European consumer law.
Article 19 - Partial Invalidity
If any provision of these Terms and Conditions is declared null, illegal or unenforceable, the remaining provisions shall remain in full force and effect.
Article 20 - Amendment of the Terms and Conditions
The seller reserves the right to amend these Terms and Conditions at any time. The Terms and Conditions applicable are those in force on the date of the order.
